Terms and Conditions

By accessing our Site or purchasing our products, you agree to be bound by these Terms. If you do not agree, you may not use the Site or purchase our products.

1. Eligibility & Use of the Site

You must be at least 18 years old to use this Site or make a purchase. By using this Site, you represent and warrant that you are legally capable of entering into a binding contract.

You agree not to:

  • Attempt to gain unauthorized access to systems
  • Interfere with Site security or performance
  • Abuse, harass, or defraud the Company or other users

We reserve the right to suspend or terminate access at our sole discretion for violations of these Terms.

2. Orders, Pricing & Payments

All orders placed through the Site are subject to acceptance and product availability. We reserve the right to refuse, cancel, or limit any order at our discretion, including for suspected fraud, pricing errors, or inventory limitations.

Prices are subject to change without notice. Payment must be made in full at the time of purchase.

Our Shipping Policy, available on our website, is incorporated into these Terms by reference and governs all matters related to shipping, delivery, processing times, shipping fees, international customs, carrier issues, and lost or delayed shipments. By placing an order, you agree to be bound by the terms of our Shipping Policy.

4. Returns & Refunds (Incorporated by Reference)

Our Return & Refund Policy, available on our website, is incorporated into these Terms by reference and governs all matters related to returns, refunds, restocking fees, return eligibility, return shipping, exchanges, and abandoned return requests. By placing an order, you agree to be bound by the terms of our Return and Refund Policy.

5. Product Use, Installation & Assumption of Risk

All products sold by SKY-MO USA LLC are intended for lawful consumer use only. Certain products, including but not limited to vehicle-mounted accessories and electrical components, involve inherent risks and require proper installation and responsible use.

By purchasing and using our products, you acknowledge and agree that:

  • You are solely responsible for determining vehicle compatibility
  • You assume all risk associated with installation, use, and operation
  • We are not responsible for improper installation, electrical damage, airbag interference, dashboard damage, vehicle electronics issues, or vehicle modifications
  • Products must never be adjusted while operating a moving vehicle
  • You assume all risk for distraction, accidents, injury, death, or property damage related to use

Proper installation is required. SKY-MO USA LLC shall not be liable for any damage, loss, or injury arising out of or related to the installation, use, misuse, modification, third-party installation, or operation of any product.

6. No Warranties

To the fullest extent permitted by law, all products and services are provided:

“AS IS” and “AS AVAILABLE” without warranties of any kind, whether express, implied, or statutory, including but not limited to:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement

We do not guarantee any specific performance, result, durability, compatibility, or suitability for any particular vehicle.

7. Limitation of Liability

To the maximum extent permitted by law:

SKY-MO USA LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Personal injury
  • Property or vehicle damage
  • Electrical system damage
  • Loss of profits
  • Loss of data
  • Accidents
  • Improper installation
  • Product misuse
  • Carrier delays
  • Website outages

Our total liability for any claim shall not exceed the amount paid by you for the specific product giving rise to the claim, regardless of whether the claim arises from contract, warranty, negligence, strict liability, third-party installation, or any other legal theory.

8. Indemnification

You agree to indemnify, defend, and hold harmless SKY-MO USA LLC, its owners, employees, affiliates, and agents from any claims, damages, liabilities, losses, costs, and attorneys’ fees arising from:

  • Your use or misuse of any product
  • Improper installation
  • Violation of these Terms
  • Violation of any law or third-party rights

9. Intellectual Property

All Site content, including text, images, branding, logos, product designs, and descriptions, is the exclusive property of SKY-MO USA LLC and may not be copied, reproduced, distributed, or exploited without prior written permission.

10. Errors, Inaccuracies & Omissions

Occasionally there may be information on our Site that contains typographical errors, inaccuracies, or omissions related to product descriptions, pricing, promotions, shipping charges, processing times, or availability. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information or cancel orders if any information on the Site is inaccurate at any time without prior notice, including after you have submitted your order.

11. Third-Party Links

Our Site may contain links to third-party websites that are not affiliated with or controlled by SKY-MO USA LLC. We are not responsible for the content, accuracy, policies, or practices of any third-party websites. Your interactions with third-party websites are solely between you and the third party, and you access such sites at your own risk.

12. User Feedback, Reviews & Submissions

By submitting reviews, comments, photos, videos, testimonials, or other content to SKY-MO USA LLC, you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, publish, translate, distribute, and display such content in any media for any purpose, including marketing and promotional purposes.

You agree that your submissions will not violate any third-party rights, including copyright, trademark, privacy, or personal rights, and will not contain unlawful, abusive, or defamatory material. We reserve the right, but not the obligation, to monitor, edit, or remove any content we determine to be inappropriate or in violation of these Terms.

SKY-MO USA LLC is not responsible for and does not endorse any user-submitted content.

14. Canadian Customers & Currency

All prices are displayed in U.S. Dollars unless otherwise stated.

Canadian customers acknowledge and agree that:

  • Currency conversion fees are their responsibility
  • Import duties, taxes, and brokerage fees are their responsibility
  • Refunds do not include customs fees already paid

15. Termination

We reserve the right to suspend or permanently terminate your access to the Site at any time, with or without notice, for any violation of these Terms or applicable law.

16. Governing Law & Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of the State of Colorado and the applicable federal laws of the United States, without regard to conflict-of-law principles.

You agree that any legal action or proceeding shall be brought exclusively in the state or federal courts located in Colorado, United States.

18. Force Majeure

SKY-MO USA LLC shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, supply chain disruptions, carrier delays, governmental actions, power failures, or internet service failures.

19. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
